The main elements in a document (contract of carriage, contract of sale, etc.) are the printed clauses and particularly the additional clauses (riders). Usually the main intentions of a party are found in the riders. With regard to the bill of lading the clauses are bound by the HVR so that very few additional clauses can be added. Some clauses are more important than others and are usually typical for the type of traffic and the type of goods being carried.
- Paramount Clause: determines which legislation is applicable. - New Jason Clause: in case of general average when the American law has to be applied. - Both to Blame Collision Clause: applicable in case of collision when the liability is determined in accordance with the American legislation. In every country, in case of collision, the proportional responsibility applies; in the United States, in case of collision, both ships are by right equally to blame, thus each for 50%. - General Average: to be settled according to the York Antwerp Rules.
- Or so near thereto as she may safely get : master must not take unnecessary risks when berthing his ship. - W eight, measure, quality, quantity, condition, contents and value unknown: only valid in two cases: suspicion of correctness and no means of checking. - On deck at shippers' risk : master or carrier is not liable
- Containers : may be carried on deck or under deck.
