MARINE POLLUTION The Merchant Shipping (BCH Code) (Amendment) Regulations 1994
The Secretary of State for Transport, in exercise of the powers conferred on him by article 3 of the Merchant Shipping (Prevention and Control of Pollution) Order 1987[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:-
5. After paragraph (3) of regulation 1 there shall be inserted the following paragraph-
3. Every chemical tanker to which these Regulations apply shall be constructed, equipped and operated in accordance with the requirements relevant to it of Chapter II to IV inclusive and VIII of the BCH Code."

The adopted amendments mean that the substances to which the requirements of the BCH Code apply are now identified solely by reference to the IBC Code, Chapter 17. The adopted amendments also make changes to the BCH Code, Chapter IV (Special Requirements) and add a new Chapter VIII (Transport of Liquid Chemical Wastes). The IMO's 1993 edition of BCH Code incorporates these amendments. The agreement relevant to these Regulations which modifies an agreement of the description mentioned is Resolution MEPC 56(33) adopting amendments to the BCH Code mentioned in Annex II to the International Convention for the Prevention of Pollution from Ships 1973 and its Protocol of 1978). back |
